
Interim City Clerk Cindy Conway’s weekend was cut short on Sunday.
Conway had to go into the City Administration Building to post notice of the Memorial Health System Board of Trustees’ special meeting at 4 p.m. Monday.
The notice was posted at 2:31 p.m.
City Attorney “Chris Melcher gave me the direction to come in and post it, so I did,” Conway said.

According to the Colorado Sunshine Law:
“Any meetings at which the adoption of any proposed policy, position, resolution, rule, regulation, or formal action occurs or at which a majority or quorum of the body is in attendance, or is expected to be in attendance, shall be held only after full and timely notice to the public. In addition to any other means of full and timely notice, a local public body shall be deemed to have given full and timely notice if the notice of the meeting is posted in a designated public place within the boundaries of the local public body no less than twenty-four hours prior to the holding of the meeting. The public place or places for posting such notice shall be designated annually at the local public body’s first regular meeting of each calendar year. The posting shall include specific agenda information where possible.”
Good thing I periodically walk by all the public buildings in Colorado Springs every Sunday, or I would have missed notification of this important meeting.
These guys just don’t get it – they are conducting the people’s business with the people’s tax dollars; discussing Dr McEvoy’s golden parachute is important… notification on Sunday afternoon to comply with the letter of the law violates the spirit and intent.
If the MHS Board is having trouble determining who they work for (NEWSFLASH: It ain’t Dr McEvoy), it’s time to seat a new Board.

They (meaning the Board of Trustees at MHS) notify on Sunday that they are holding a meeting Monday….what is wrong with the notification timing on this? Specifically because it is a closed session meeting. They are in compliance with 24-6-402, while underhanded, it does comply.
Now the question is, why did they schedule an emergency session just prior to the announced Tuesday City Council ‘Emergency’ meeting? Another slap in the face from the MHS Trustees to the Colorado Springs taxpayers by approving the $1.15Million in a rush before City Council can remove them?? maybe.
